SB 1079/Civil Code § 2924m Disclaimer
For California foreclosure sale auctions conducted after January 1, 2021, with respect to properties containing from one to four residential units, the post-auction bidding process outlined in California Civil Code section 2924m may apply. All bidders at a public auction of property subject to Civil Code section 2924m should be aware the highest bidder at the public auction may not ultimately be entitled to the property; a post-auction bidding process, which could be extended for up to 45 days after the public auction, may result in the property being granted to another entity or individual who qualifies as a “prospective owner-occupant,” “eligible tenant buyer,” or “eligible bidder” under California Civil Code section 2924m. Under California Civil Code section 2924m, certain individuals may also be able to forgo the post-auction process and conclude the foreclosure sale at auction if they are the highest auction bidder and submit the necessary affidavit or declaration to qualify as a “prospective owner-occupant” to the auction vendor at the trustee’s sale or to the trustee by 5 p.m. on the next business day following the trustee’s sale. If you think you may qualify as a “prospective owner-occupant,” “eligible tenant buyer,” or “eligible bidder” under California Civil Code section 2924m, you should consider contacting a competent attorney or real estate professional immediately for advice regarding your potential right to purchase the property. All bidders should also be aware Civil Code section 2924m does not require the foreclosure trustee to pay interest on funds tendered by the highest auction bidder if those funds are later returned to the highest auction bidder after completion of the post-auction process. The disclosure of sale information on this website during the 45-day period after a public auction, as required by Civil Code section 2924m, does not constitute a representation that the post-auction bidding process under Civil Code section 2924m is applicable to a specific property.
